Terms of Service

Important notice – These Terms constitute a binding agreement between you (“you”, “User”) and Giorgio Barilla, sole trader registered in the Czech Republic, IČO 22432604, doing business as Automagify (“Automagify”, “we”, “us”, “our”). By accessing or using automagify.com or any linked sub-domain (collectively, the “Site”) you agree to be legally bound by these Terms. If you do not agree, do not use the Site.

1. Definitions

  • “Content” – all text, graphics, code, data, software, videos, sound, music, interactive features and other materials available on or through the Site.

  • “Services” – the Site, any newsletters, marketing emails, downloadable resources, demo access and other features we make available now or in the future.

  • “User Content” – any data, text, files, feedback or other material that you submit to or via the Services.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract in your jurisdiction. By using the Services, you confirm that you satisfy these requirements.

3. Modification of Terms

We may revise these Terms at any time by posting the updated version on the Site and changing the “Last updated” date. Revisions become effective on posting. Continued use after that date constitutes acceptance of the revised Terms.

4. Description of Services

Automagify provides information and early-access registration regarding forthcoming AI automation solutions aimed at businesses. All information is offered “as is” for general informational purposes; it does not constitute professional advice or an offer to contract until we expressly confirm acceptance of an order in writing.

5. Account Registration

  1. You may browse most pages without creating an account. Certain features (e.g. demo dashboards) may require registration.

  2. You must provide accurate, current information and keep it updated.

  3. You are responsible for safeguarding your login credentials and any activities that occur under them. Notify us immediately of unauthorised use.

6. Licence & Intellectual Property

  1. We Own the Site – All Content and intellectual-property rights belong to Automagify or its licensors and are protected by EU and international laws.

  2. Limited Licence to You – We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Services for lawful purposes in accordance with these Terms.

  3. Restrictions – You may not:

    • copy, modify, adapt, translate, reverse-engineer or create derivative works from the Services;

    • sell, rent, lease, sublicense or distribute the Services;

    • remove proprietary notices or circumvent security features.

7. User Content

  1. Your Responsibility – You represent that you own or have the rights to submit User Content and that it does not infringe any third-party rights or violate law.

  2. Licence to Us – By submitting User Content you grant Automagify a worldwide, royalty-free, sublicensable licence to use, reproduce, display, adapt and distribute such content for the purpose of operating, promoting and improving the Services.

  3. We reserve the right to remove User Content for any reason, including violation of these Terms.

8. Acceptable Use

You agree not to:

  • use the Services in a way that violates applicable law or regulation;

  • upload malware or attempt to gain unauthorised access to networks or data;

  • harass, threaten, defame or abuse others;

  • use any automated means (bots, scrapers) to access the Site without our prior written consent;

  • interfere with or disrupt the integrity or performance of the Services.

9. Third-Party Links & Resources

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for their content, policies or practices and you access them at your own risk.

10. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, title and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free or that data loss will not occur.

13. Limitation of Liability

  1. Nothing in these Terms limits liability where it is unlawful to do so (e.g., for death or personal injury caused by negligence, fraud or gross negligence).

  2. To the fullest extent permitted by law, Automagify shall not be liable for:

    • indirect, incidental, special, punitive or consequential losses;

    • loss of profits, revenue, data, goodwill or business opportunities.

14. Termination & Suspension

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to us or other Users. Upon termination, all licences terminate and you must cease all use of the Services. Clauses that by their nature should survive (e.g., intellectual property, indemnification, limitation of liability) shall survive termination.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Czech Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods.

16. Dispute Resolution

  1. Amicable resolution: Contact us first at info@automagify.com; we aim to resolve disputes within 30 days.

  2. Consumer-ADR: If you are a consumer domiciled in the EU, you may submit a complaint via the European ODR Platform (ec.europa.eu/odr).

  3. Exclusive jurisdiction: Failing amicable resolution, the courts of Prague 1 shall have exclusive jurisdiction, unless mandatory consumer law gives you the right to sue in your home forum.

17. Electronic Communications

You agree that all agreements, notices and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

18. Force Majeure

Neither party is liable for failure to perform caused by events beyond its reasonable control (e.g., natural disasters, war, terrorism, labour disputes, utility failures, governmental acts).
